These Terms of Service (“Terms”) govern your access to and use of the Eightfiora website and related services (collectively, the “Services”). These Terms constitute a legally binding agreement between you (“you,” “Customer”) and Eightfiora LLC (“Eightfiora,” “we,” “us,” “our”).

By using the Services or placing an order, you agree to be bound by these Terms.

1. Eligibility

You represent and warrant that you are at least the age of majority in your jurisdiction and possess the legal authority to enter into this agreement. If you are using the Services on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.

2. Products and Product Information

We strive to display our products accurately. However, you acknowledge that:

  • Visual Variations: Colors may vary based on your monitor, device settings, or lighting conditions.
  • Production: Small variations in appearance or measurements may occur as a natural result of our made-to-order production process.
  • Guides: Size charts and product descriptions are provided as guides; minor deviations do not constitute a defect.

3. Orders, Acceptance, and Payment

  • Order Acceptance: Your order is an offer to purchase. We reserve the right to accept, reject, or cancel orders at our sole discretion, including but not limited to instances of suspected fraud, production limitations, or pricing errors.
  • Pricing: Prices are subject to change without notice. In the event of a listing error, we reserve the right to cancel your order and issue a full refund.
  • Payment: You authorize us (and our third-party payment processors) to charge your selected payment method for the total order amount, including all applicable taxes and shipping fees.

4. Production, Shipping, and Delivery

  • Timeline: Production times are estimates and not guarantees.
  • Address Accuracy: You are responsible for providing a complete and accurate shipping address. We are not liable for packages lost or returned due to incorrect information provided by you.
  • Carrier Liability: Once a package is transferred to the carrier, we are not responsible for delays caused by weather, customs, or carrier handling.
  • Risk of Loss: Title and risk of loss for items pass to you upon our delivery of the items to the carrier.

5. Order Changes & Cancellations

Due to our made-to-order model, we can only accommodate cancellations or modifications within 2 hours of purchase, provided the order has not yet entered the production phase.

6. Returns, Replacements, and Refunds

All returns, replacements, and refunds are governed by our Refund Policy. In the event of any conflict between these Terms and the Refund Policy, the Refund Policy shall control regarding return-related issues.

7. Intellectual Property

All content on the Services—including logos, designs, text, graphics, and images—is the exclusive property of Eightfiora LLC or its licensors. You may not reproduce, distribute, or create derivative works without our express written permission.

8. User Content

If you submit reviews, photos, or testimonials, you grant Eightfiora a non-exclusive, royalty-free, worldwide license to use, publish, and display such content for marketing and operational purposes. You represent that you own or have the rights to the content you submit.

9. Prohibited Conduct

You agree not to use the Services for any unlawful purpose, interfere with the security of the website, attempt to gain unauthorized access to our systems, or infringe upon the rights of others.

10. Disclaimer of Warranties

To the maximum extent permitted by law, the Services and products are provided “as is” and “as available.” We disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law:

  • Eightfiora will not be liable for any indirect, incidental, or consequential damages.
  • Our total liability for any claim arising from your purchase will not exceed the amount actually paid by you for the specific item giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Eightfiora LLC, its officers, and employees from any claims, liabilities, or expenses (including legal fees) arising from your misuse of the Services or your violation of these Terms.

13. Governing Law & Venue

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, USA, without regard to its conflict-of-law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in New Mexico.

14. Changes to These Terms

We may update these Terms periodically. The “Effective date” at the top indicates the latest version. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.
