These Terms of Service (“Terms”) govern your access to and use of the Eightfiora website and related services (collectively, the “Services”), including any purchases you make through our store. These Terms are a legally binding agreement between you (“you,” “Customer”) and Eightfiora (“Eightfiora,” “we,” “us,” “our”). By using the Services or placing an order, you agree to these Terms.

1) Eligibility

You must be able to form a legally binding contract in your jurisdiction. If you use the Services on behalf of an entity, you represent that you have authority to bind that entity.

2) Products and Product Information

Eightfiora designs all products sold on our website. We strive to display product details accurately, including colors, materials, and sizing.

You acknowledge that:

  • Colors may vary due to monitor/screen settings, lighting, and device differences.
  • Minor variations in appearance may occur as a normal result of production.
  • Product measurements and size charts are guides; small deviations may occur.

3) Orders, Acceptance, and Payment

  • Order acceptance: Your order is an offer to purchase. We may accept, reject, or cancel orders in our discretion, including due to suspected fraud, production limitations, address issues, or pricing/description errors.
  • Pricing: Prices and availability may change without notice. If a pricing or listing error occurs, we may cancel and refund your order or request confirmation before proceeding.
  • Payment: You authorize us (and our payment processors) to charge your chosen payment method for your order total, including applicable taxes and shipping fees.
  • Taxes and fees: You are responsible for applicable taxes and fees unless otherwise stated at checkout.

4) Production, Shipping, and Delivery

  • Production and handling: Some items may be produced and shipped after your order is placed. Production and handling times may vary by product and season.
  • Delivery estimates: Any estimated delivery dates are estimates only and not guarantees.
  • Shipping region: We ship to destinations shown as available at checkout.
  • Address accuracy: You are responsible for entering a complete and correct shipping address. If an order must be reshipped due to an incorrect or incomplete address provided by you, additional shipping fees may apply.
  • Carrier delays: We are not responsible for delays caused by carriers, customs, weather, or events beyond our reasonable control.
  • Risk of loss/title: Risk of loss transfers as permitted by applicable law. If your jurisdiction provides mandatory consumer protections regarding risk of loss, those protections apply.

5) Order Changes & Cancellations

We can cancel or update an order within 2 hours of purchase only if it has not entered production or shipping. After that, changes may not be possible.

6) Returns, Replacements, and Refunds

Our returns, replacements, and refunds are governed by our Refund Policy (available on a separate page). In the event of any conflict between these Terms and the Refund Policy, the Refund Policy will control for return/refund-related issues.

7) Promotions, Discount Codes, and Store Credit (if applicable)

Discount codes and promotions:

  • may be time-limited and subject to additional terms shown at checkout,
  • cannot be applied retroactively unless we explicitly agree,
  • may exclude certain items.

If store credit is offered, it has no cash value unless required by law.

8) Intellectual Property

All content on the Services (including trademarks, logos, designs, product photos, text, graphics, and site content) is owned by Eightfiora or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without prior written permission.

9) User Content (Reviews, Photos, Submissions)

If you submit reviews, images, testimonials, or other content (“User Content”), you grant Eightfiora a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and display that User Content for marketing and operational purposes, subject to applicable law. You represent that you have the rights to submit the User Content.

10) Prohibited Conduct

You agree not to:

  • violate any laws or regulations,
  • interfere with the operation or security of the Services,
  • attempt unauthorized access to systems or accounts,
  • use the Services to infringe third-party rights.

11) Disclaimer of Warranties

To the maximum extent permitted by law, the Services and products are provided “as is” and “as available.” We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Some jurisdictions do not allow certain disclaimers; in that case, these disclaimers apply to the fullest extent permitted.

12) Limitation of Liability

To the maximum extent permitted by law:

  • Eightfiora will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill.
  • Eightfiora’s total liability for any claim arising out of or relating to the Services or products will not exceed the amount you paid for the order giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law.

13) Indemnification

You agree to indemnify and hold harmless Eightfiora and its affiliates, officers, employees, and agents from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Services, violation of these Terms, or infringement of third-party rights.
